1. Agreement to Terms
By engaging Samuel Design Company (“Company,” “we,” “us,” or “our”) for services or using our website, you (“Client,” “you,” or “your”) agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Overview
Samuel Design Company provides comprehensive creative services including but not limited to:
— Photography and videography
— Graphic design and branding
— Creative direction and visual identity
— Custom templates and marketing materials
— Post-production services (editing, formatting, rendering)
— Digital asset creation and optimization
— Physical installations and environmental design
— Custom artwork and commissioned pieces
Specific project scope, deliverables, timeline, and compensation will be outlined in individual project proposals and contracts.

3. Project Process & Client Responsibilities
Project Initiation: Work begins within 2 business days of receiving signed agreement and non-refundable deposit.
Timeline: Estimated completion is typically 10–14 business days from start date, depending on scope and timely feedback.
Client Feedback: Feedback must be provided within 5 business days of each deliverable. Lack of response is considered approval.
Revision Process: Revisions vary per package. A revision includes all consolidated feedback. Additional revisions are billed at current rates.

4. Payment Terms
Deposits: A 50% non-refundable deposit is required before work begins.
Final Payment: Remaining balance is due upon completion and before final delivery.
Late Payments: May incur additional fees and delay project timelines.
Additional Services: Add-ons requested before final delivery will be billed separately.

5. Add-On Services & Additional Work
Examples include:
— Additional design variations or templates
— Extended revision rounds
— Rush delivery
— Supplementary creative assets
— Copywriting
— Enhanced post-production
Add-ons are priced individually and require written approval. They may affect project timelines.

6. Intellectual Property & Usage Rights
Client Rights: Usage rights are granted upon full payment as specified in each agreement.
Portfolio Rights: We may showcase completed work unless agreed otherwise.
Client Content: Client must own or license all content provided.
Third-Party Materials: May require additional licenses. We’ll inform you of usage restrictions. Samuel Design Company is not liable for misuse or unlicensed use.

7. Project Changes & Cancellations
Pre-Work Cancellation: The non-refundable deposit applies.
Post-Work Cancellation: A 25% cancellation fee applies, in addition to the deposit.
Designer Cancellation: In unforeseen cases, completed work will be delivered and payment adjusted accordingly.

8. File Delivery & Communication
Formats: As specified in project agreements.
Delivery: Via email or secure file sharing unless otherwise agreed.
Communication: Mainly through email or mutually agreed channels.

9. Force Majeure
Neither party is liable for delays caused by uncontrollable circumstances such as natural disasters, technical failures, or government action.

10. Governing Law
These terms are governed by the laws of the State of Florida and North Carolina, depending on project location. Disputes will be resolved in the jurisdiction where services are performed or where the primary relationship exists.

Service providers: GoDaddy, Dropbox, Google Drive, etc.

Project records: Retained for 7 years
Marketing data: Retained until you opt out
Website data: Retained as needed for business use
